SALE OF PUPPIES

Whilst all efforts are made to ensure the puppies are healthy and well no responsiblity can be borne by the breeder if the puppy has no success in the show ring/field trial   or is infertile.   These are conditions which are impossible to predict.   Neither can the breeder be held responsible for illness which occur later in life.   Wear and tear, and lifestyle all have an impact on a dog and the breeder does not accept responsibility for any illness, congenital or otherwise,   which occur after   3 months of age.   The Purchaser has 3 working days to take the puppy to the vet and a further 4 days complete to return the dog due to defect after sale.   On production of a written report from a vet the full refund price will be refunded.   All Terms and conditions listed in the sales contract apply.

Under KC regulations there are two types of endorsements which may be placed on a puppy; export and breeding.   Endorsements can only be lifted by the person who places them.   The breeder will only lift the breeding endorsement IF the   puppy is over 2 years of age AND she believes that it is in the best interests of the breed and the puppy in particular.   The puppy has to have a hip score done under the BVA scheme and if the score is higher than the breed average then the restriction may not be lifted.   The breeder accepts no responsibility and no refunds will be forthcoming in this situation.   The puppy has been sold as a pet and is priced as such.   If the purchaser wishes to breed with the puppy then an administration fee of £100 must be paid to the breeder to lift the endorsement.   The breeder may decide it is not in the interests of the puppy to do so and may choose not to lift the endorsement.   The breeder does not have to give any reason why she will not lift the endorsement.   No fee is then payable, and no refunds for the purchase price will be given.

The breeder strongly recommends that all puppies be insured through any comprehensive pet insurance company.   No responsibility is accepted by the breeder for any puppy not insured.   It is in the interests of the puppy and the owner to be fully insured.  

The purchaser agrees that in the event of the puppy needing to be rehomed then the breeder should be informed and if requested the puppy should then be returned to the breeder and the cost of which is to be borne entirely by the purchaser.   The breeder will then search for a suitable home for the dog and the purchaser will be reimbursed the sale cost of the puppy minus any and all affiliated costs to the breeder for food, vets ect.   The fiscal value of the dog will be determined by the breeder.

If for any reason the breeder has not received all and complete funds for the puppy, it will remain her property until the puppy is paid for in full.   If the final and complete payment is not made then the purchaser agrees that that the puppy is still the sole property of the breeder and the purchaser agrees to turn over the puppy on demand to the breeder, forfeiting any and all monies paid to date and has no further claim on either the puppy or the money.   The purchaser cannot sell the puppy on as the puppy is still the property of the breeder and is not the property of the purchaser until ALL monies are paid.   At such a time the breeder is not responsible for any vets bills, food bills or any other affiliated costs of the puppy for the period in which the puppy stayed with the purchaser.   If, before the puppy is paid for in full, the purchaser decides that they no longer want the puppy for ANY reason then the purchaser must relinquish the puppy to the breeder at their own costs and forfeits any claim to moneys paid.   The breeder agrees that on receipt of final payment she may post the KC documents for the puppy.   The purchaser is advised that the KC insurance for the puppy is not active until the papers are returned to the KC.   Any person who does not pay for the puppy in full will be issued with a small claims court summons to appear before a judge.  If payment is not received after the court has issued a payment order then a CCJ will be enforced.  On this occasion the KC papers will not be forwarded until payment is received in its entirety BUT the endorsement will not be lifted under any circumstances.

Paying the initial deposit/payment in full, whichever comes first,   enters the purchaser into all the terms and conditions listed here and in the contract that is signed.   No puppy can be held for a purchaser without a deposit.
